The Court of Appeal in Abuja, has ordered the reinstatement of Ambassador Mohammed Dauda, as Director General of the National Intelligence Agency (NIA).
Justice Peter Ige made the order on Thursday, while ruling on an appeal filed by the NIA.
The appeal followed the judgement of the National Industrial Court, Abuja, that earlier ordered the reinstatement of Dauda as head of the NIA, as well as payment of salaries and entitlements from March 2018 till date, after it found that his dismissal fell short of the NIA Act.
Justice Olufunke Anuwe had held that under the NIA Act, the management staff disciplinary committee was the appropriate authority to investigate disciplinary cases against management staff and “not the special management staff disciplinary committee” which investigated Dauda.

Delivering judgement on Thursday, in an appeal filed against the ruling, Justice Ige, held that there is no evidence before the court that shows the respondent, Dauda, has constituted any risk or breached any law.
“The appellant’s appeal is hereby dismissed for lacking in merit and the Industrial Court judgement is hereby affirmed,” the court ruled.
It further awarded the sum of N1 million against the NIA and ordered that Dauda be allowed to retire in service in accordance with the stipulated laws.
